By purchasing from this website, you (“the Customer”) agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not purchase from our store.

2. Artistic Nature of Goods

2.1. Handmade Disclaimer: Please note that our products are often handmade or unique artistic creations. Minor imperfections, variations in colour, texture, or finish are not defects but are inherent qualities of the artwork. 2.2. Representation: We make every effort to display the colours and images of our products accurately. However, we cannot guarantee that your computer monitor’s display of any colour will be accurate. 2.3. One-of-a-Kind: Unless otherwise specified (e.g., prints), items are unique. Once sold, they cannot be replicated exactly.

3. Pricing and Payment

3.1. All prices are quoted in South African Rand (ZAR). 3.2. We reserve the right to modify prices at any time without prior notice. 3.3. Payment must be made in full at the time of ordering. Ownership of the goods remains with Scraptacular Creations until full payment has been received and cleared.

4. Shipping and Delivery

4.1. Delivery Areas: We currently ship to addresses within South Africa. [Optional: and International addresses]. 4.2. Timelines: Delivery times are estimates. We are not liable for delays caused by courier services, strikes, or force majeure events. 4.3. Risk of Loss: The risk of loss and title for items purchased pass to you upon our delivery of the item to the carrier/courier. Please ensure you provide a secure delivery address.

5. REFUND AND RETURNS POLICY (STRICT)

Please read this section carefully before making a purchase.

5.1. All Sales Are Final: Due to the artistic, fragile, and often custom nature of our goods, we do not offer refunds, returns, or exchanges. 5.2. No Change of Mind: We do not accept returns based on “change of mind,” buyer’s remorse, or if the item does not fit your specific decor needs. Please review all photos, dimensions, and descriptions carefully before purchasing. 5.3. Commissions and Custom Orders: Custom-made or commissioned pieces are strictly non-refundable under any circumstances once the deposit has been paid or work has commenced.

Defective or Damaged Goods (CPA Compliance) 5.4. While our general policy is “No Refunds,” we comply with the South African Consumer Protection Act (CPA) regarding defective goods. 5.5. If an item arrives physically damaged or materially defective, you must notify us strictly within 48 hours of delivery at [Insert Email Address]. 5.6. You must provide clear photographs of the damage and the original packaging. 5.7. If the damage is deemed to be a production flaw (and not courier damage or normal wear and tear), we may, at our sole discretion, offer a repair or a store credit. Cash refunds are not provided unless legally mandated by the specific circumstances of the defect under the CPA.

6. Intellectual Property

6.1. All content on this website, including but not limited to images, text, logos, and the artwork itself, is the intellectual property of Scraptacular Creations and the artist. 6.2. Copyright: The purchase of an artwork does not transfer copyright to the buyer. You may own the physical object, but the artist retains all rights to reproduce, print, or license the image of the artwork. You may not reproduce the artwork for commercial gain without written permission.

7. Limitation of Liability

7.1. To the maximum extent permitted by South African law, Scraptacular Creations shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products. 7.2. Our total liability to you for any claim arising out of or in connection with these Terms or the use of our products shall not exceed the amount paid by you for the specific product giving rise to the claim.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
